




Construction Liens
The timelines to preserve and perfect a lien are strict and are an essential component to enforcing your rights for the materials and services you supplied to the improvement of a property.
General Contractor
For a general contractor who is retained directly by the owner, a construction lien must be registered within 60 days of the earlier of:
(a) when a certificate of declaration of substantial performance is published (if any);
(b) when the contract is completed, abandoned or terminated.

Subcontractor or Sub-Subcontractor
For a subcontractor or sub-subcontractor a construction lien must be registered within 60 days of the earlier of:
(a) when a certificate or declaration of substantial performance is publichsed (if any);
(b) when the person last supplied materials or services to the project;
(c) when the contract is completed, abandoned or terminated;
(d) when the subcontract is certified as completed.
After Preservation: Perfection
Once you have successfully preserved a construction lien, you are required to perfect the said lien by commence a court action to enforce the claim for lien and register a certificate of action on the title to the property where the work was completed.
