Small Claims Court

WHAT IS SMALL CLAIMS COURT?

In Ontario, the Small Claims Court is a brach of the Superior Court of Justice. Small Claims Court deals with disputes of monetary value of up to $35,000 (Canadian) and follows simplified rules and procedures.

WHAT KIND OF CASES GO TO SMALL CLAIMS COURT?

Small Claims Court is used to handle any action for the payment of money or the recovery of personal property where the amount that is being claimed does not exceed $35,000.

EXAMPLES OF SMALL CLAIMS COURT ACTIONS:

  • Unpaid accounts for goods or services sold and delivered

  • Unpaid loans

  • Unpaid rent

  • NSF cheques

  • Property damage

  • Breach of Contract

  • ... and many more
